- My craziest idea for Constitutional reform is that there ought to be popular elections to banish people, like ostracism in ancient Athens. No primaries, no names printed the ballots, but if a high enough % of the populace write in somebody's name, away they go.

- The only way I can read that opinion is that there are five votes on the Supreme Court for extrajudicial detention and gulag slavery, but less than five votes for stating it openly. Hence the weasel words about "facilitating."
