- Today, I am suing the EHRC and will publish the letter before claim for judicial review shortly.
- Westminster has three Henry VIII powers to give clarity and certainty to gender recognition: Schedule 2 of the Human Rights Act, section 23 of the Gender Recognition Act, section 14 (prospective) of the Equality Act. But they behave as though they are bound by the Supreme Court.
- One of the key principles of the Gender Recognition Act is that no one is required to assist another person in claiming an exemption, whether under the GRA or EA10. Oh wait, it’s deeper than that, it’s a basic tenet of common law!
- 1/🧵 Many new archive finds. The UK considered in 2002 to use a remedial order under the Human Rights Act to bring the law into compliance with Goodwin & “I”. The government opted for primary legislation because of the “complex knock-on effect”.
