Today's 6–3 decision by the Supreme Court effectively allows the Trump administration to start implementing his ban on transgender troops—not just barring their enlistment, but purging those already serving. An appeals court already put the other nationwide injunction against the policy on hold.

Surprising: the common man wisdom seems to be “like it or not the Constitution gives enormous power over the military to the President”. NO IT DOES NOT. That power belongs to Congress. Art I sec 8. Congress creates the military and sets the rules for its operations. CONGRESS!!!

Would love to understand how SCOTUS will square the circle that discrimination is now legal given basic equal protection law. They are coming for gay marriage next, and possibly interracial marriage. And Schumer and Carville just want to sit back and let the country go back to 1915.

Why does this require extraordinary “emergency” intervention by the Supreme Court instead of letting the case play out in the regular order of the lower courts? The Trump regime has made over a dozen “emergency” appeals to the Court in its first 100 days. Bush and Obama only made 8 in 16 years.

Preliminary injunctions are supposed to preserve the status quo while the case proceeds. The district court's injunction did that. Halting it allows the government to proceed with kicking people out of the military while the case is still pending. It's absurd.

What a sickening and disgusting outcome for America that people who wanted to serve their country cannot because of the actions of an unrepentant draft dodger whose daddy paid his way out of the military with imaginary "bone spurs." What a sad and pathetic day for this country.

I thought the whole point of injunctions like this was to keep the status quo (or the least disruptive option) to give courts time to hear and decide? Surely firing (and potentially rehiring) thousands of troops is more disruptive than not?

From wimpy Trump who was afraid to serve so he dodged the draft. Oh, he had heal spurs. I've run marathons and ultra triathlons with heal spurs and broken them up with a massage gun. He just can't handle that trans folks volunteer for something he was too afraid to do.

Citing no particular precedent, statute, or constitutional authority. For that matter the roberts court itself has no legitimacy left to issue anything other than non-binding advisory opinions. People should stop pretending otherwise.

This is cruel and despicable. They are knowingly doing harm with this, aware that much damage will be done however the case comes out. The only appropriate response was to maintain the status quo (i.e., stop the ban) until the case is decided. SCOTUS is corrupt in more than one way.

The argument seems to reduce to "Trump can be a bigot because reasons." The arguments he makes are the same ones that kept the military segregated from the Civil War until WWII. "It's bad for morale" to keep bigots from getting their way.

I was denied joining the military because I had braces on my teeth. I was told the military didn’t want to be responsible for my medical appointments. Orthodontic medical care is nothing compared to transgender medical care and surgeries that the armed services would be responsible for. I get it.

The conservative judges really are politicians. They don't support the rule of law. Whether you agree or disagree with trans folks serving, they should be allowed to serve until a final ruling is made.

This should have been the easiest case imaginable - a straightforward con law exam question for 1Ls. The Govt took a discriminatory action against a minority group and justified it by saying "that minority group is bad."
