The government is now up: Michael P. Drescher. Judge Sessions notes that he called the Second Circuit's previous decision wonderful. A sign for where the wind's blowing?

NEWS Judge Sessions: “The court finds that Ms. Öztürk has sufficiently established all three factors" required for her release.

Judge Sessions says the only evidence the government produced for the detention is the op-ed. "That literally is the case. There is no evidence here as to the motivation absent the consideration of the op-ed."

Judge: “These are very substantial claims of First Amendment and due process violations.”

This is a thundering ruling. He hasn't formally issued it yet, but it's clear where it's going.

Sessions: "Her continued detention chills the speech of the millions and millions of people who are not citizens." The court finds "her continued detention cannot stand."
