- This would have been a deferred prosecution under normal times, maybe even just a declination. DOJ is doing this type of case instead of pursuing real criminals.

- The problem is that if the agents were acting under color of law, there is a broad right to remove the case to federal court under 28 USC 1442, which puts the case in the hands of the U.S. Attorney who will dismiss the case.

- For better or worse, current DOJ policy is to seek the highest readily provable charge in every case. Why only depart from this policy when it helps someone who abused their authority? Maybe the policy is not a good one; in that case, don’t apply it to anyone.

- Lots of confusion out there about what Scotus will consider on birthright citizenship. It's actually pretty clear: They are NOT ruling on the legality of Trump's EO, though the subject will surely come up and the decision will determine whether the restrictions go into partial effect right away. 1/3
- The Trump applications, which will be the subject of the May 15 argument, are all about nationwide injunctions and the standing of the states that sued. They aren't about whether the lower courts were wrong to say the EO violates the 14th Amendment and/or Scotus precedent. 2/3
- This is helpful context that I have not seen elsewhere. Interesting case for the Court to consider this issue. Could it be that children born in one district will be treated as citizens and those born in another will not be, until the end of the lawsuit when it is all resolved by SCOTUS?
- Trump’s sputtering response to Harvard standing up to him is yet another reason why institutions should refuse to bend the knee. He’s a paper tiger, unable to argue his own case.

- I understand the sentiment here, but wouldn’t the charges against ICE officials just be removed to federal court and that would be that? Section 1442 removal is meant to prevent state prosecution of federal agents. It is an extension of the principle of federal supremacy.

- I think it is not hard to imagine circumstances in which we would not want a court to force the government to prosecute someone that the government does not want to prosecute (because the defendant is innocent or because the prosecution is not in the public interest).

- I agree that the words matter and I appreciate the correction. I don’t think it changes the meaning of what he was saying, in the context of what’s been said before and his wife’s upcoming “scouting visit” to Greenland.
