Okay let’s work the problem: content-based speech restrictions like this are default unconstitutional unless the gov proves banning these ads is the least restrictive means of achieving a compelling state interest. Hard! And “ads” are now social media so… are you banning drug cos from tweeting?
I think it would make a big difference in our health if we banned Pharma ads from America like the rest of the world does.
(just FYI! Ads are actually subject to intermediate scrutiny under commercial speech doctrine... see Central Hudson! completely agree w line-drawing difficulties, but ... doctrine attempts it!)
