Feel the need to say, once again, that it deeply offends me as a free speech scholar *and* as Jewish person that universities claim to be doing this to protect Jews. That way lies a society more authoritarian *and* more antisemitic.
This is such a good point I'm frustrated I didn't see it. If the gov issues a clearly illegal order that applies to millions and it is losing in every individual case, why would it ever appeal the losses? So what if they can't enforce it as to a dozen people if they can still do it for millions?
Paraphrasing here...
Kagan: Assume this is completely illegal EO. How do the courts actually stop it?
Govt: Certify a class action.
Kagan: You'll argue there's no class to certify under FRCP.
Govt: Yeah true.
Kagan: So how else?
Govt: Have every individual affected sue.
Barrett: Seriously?
Feigenbaum: Not since the Civil War have we had US citizenship status change when you cross state lines.
They don't know how it will work bc there is no alternative to proving U.S. citizenship for children born in this country other than birth certificates - and this will impact *every* child born here.
OMFG, the SG says they “don’t know” how it’s going to work bc they never had a chance to implement the order
Like - they were and are maybe just going to throw shit at the wall with babies? And citizenship? And see what works???
This white genocide debacle highlights another reason to be extremely cautious of AI that I don't see people talking about much--if you're getting your information from AI, your knowledge will be selectively curated by the people who control the AI
